Welcome to Bubele. Throughout these Terms, the terms “we,” “us,” and “our” refer to Bubele.

Bubele operates this website and online store, including all related information, content, features, tools, products, workshops, vouchers, kits, and services, in order to provide you with a curated shopping and creative workshop experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, including our Privacy Policy, Refund Policy, and Shipping Policy, set out the terms and conditions that govern your use of the Services.

Please read these Terms carefully before using our Services. By accessing, browsing, booking a workshop, purchasing a product, purchasing a voucher, or using any part of the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Services.

SECTION 1 - ELIGIBILITY, ACCESS AND ACCOUNT

By using our Services, you represent that you are at least the age of majority in your country of residence, or that you are the age of majority in your jurisdiction and have given us your consent to allow any minor dependents to use the Services, purchase products, or participate in workshops where permitted.

To use certain parts of the Services, including placing an order, purchasing a voucher, booking a workshop, or arranging delivery, you may be required to provide certain information, such as your name, email address, billing address, payment details, delivery address, and other order-related information. You agree that all information you provide to us is accurate, current, and complete, and that you have the legal right to provide such information.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not transfer, sell, assign, or otherwise license your account to any other person.

SECTION 2 - PRODUCTS, WORKSHOPS AND SERVICES

We make every effort to display our products, workshops, vouchers, kits, and services as accurately as possible. However, we cannot guarantee that product colours, textures, sizes, materials, or other visual details shown on your screen will be fully accurate, as display settings may vary depending on your device.

We do not warrant that the appearance, quality, or other characteristics of any product, handmade item, workshop result, jewellery piece, or service purchased by you will exactly match how it appears on the Services.

All product descriptions, workshop descriptions, pricing, availability, workshop dates, and promotions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product, workshop, voucher, kit, or service at any time and to limit quantities or availability offered to any person, household, geographic region, or jurisdiction on a case-by-case basis.

Bubele offers Art Clay Silver workshops, creative kits, vouchers, and related services. Workshop bookings are for the selected date, time, location, and number of participants stated on the relevant product page or order confirmation.

SECTION 3 - ORDERS AND BOOKINGS

By placing an order or booking a workshop, you are making an offer to purchase the selected product, voucher, kit, workshop place, or service. We reserve the right to accept or reject any order at our sole discretion.

Your order is not accepted until we send you an order confirmation or otherwise confirm acceptance. We must receive and successfully process your payment before your order is accepted.

Please review your order carefully before submitting it. Once an order or workshop booking has been accepted, we may not be able to cancel, change, transfer, or modify it.

If we change, reject, or cancel an order or workshop booking, we will attempt to notify you using the email address, billing address, and/or phone number provided at the time the order was placed.

All purchases and bookings are subject to our Refund Policy.

You represent and warrant that any products, vouchers, kits, or workshop places purchased from us are for your own personal or household use only, and not for resale, commercial use, or export unless expressly authorized by us in writing.

SECTION 4 - PRICING, BILLING AND TAXES

All prices, discounts, and promotions are subject to change without notice.

All prices are shown in Swiss francs (CHF), unless expressly stated otherwise.

Bubele is currently not registered for Swiss value added tax (Mehrwertsteuer / MWST). Therefore, no Swiss VAT is charged or shown separately.

The price charged for a product, voucher, kit, workshop, or service will be the price in effect at the time the order is placed and will be stated in your order confirmation email.

Unless expressly stated otherwise, listed prices do not include shipping fees, handling charges, customs duties, import fees, or similar charges. Any applicable shipping or delivery costs will be displayed during checkout before the order is submitted.

You agree to provide current, complete, and accurate purchase, payment, billing, delivery, and account information for all transactions made through our Services. You agree to promptly update your account and other information, including your email address and payment details, so we can complete your transactions and contact you when necessary.

You represent and warrant that:

- the payment information you provide is accurate and complete;
- you are authorized to use the selected payment method;
- charges incurred by you will be honored by your payment provider; and
- you will pay all charges incurred by you at the prices in effect at the time of purchase, including any applicable shipping charges and taxes.

SECTION 5 - WORKSHOPS AND CREATIVE SERVICES

Bubele offers Art Clay Silver workshops, creative kits, and related services. Workshop bookings are for the selected date, time, location, and number of participants stated on the relevant product page or order confirmation.

Participants are responsible for attending the workshop on time and following the safety, handling, and care instructions provided by Bubele during the workshop. Art Clay Silver workshops involve manual work with small tools, materials, water, sanding, polishing preparation, and later firing of the created pieces.

Unless expressly stated otherwise, the workshop price includes the amount of Art Clay Silver stated on the product page, use of workshop tools during the workshop, basic guidance, and the finishing steps described in the product description, such as drying, firing, sanding, polishing, packaging, and preparation for collection or delivery.

Each jewellery piece is handmade by the participant. Small differences in shape, texture, surface, colour, size, finish, or final appearance are part of the handmade process and do not constitute a defect.

After the workshop, Bubele may complete finishing steps such as drying, firing, sanding, polishing, attaching basic findings, packaging, and preparing the piece for collection or delivery. The exact completion time may vary depending on drying time, firing schedule, material behaviour, workload, and delivery conditions.

Art Clay Silver shrinks during firing. The final size and appearance of a piece may therefore differ from the unfired piece created during the workshop. Bubele will handle all pieces with reasonable care, but cannot guarantee a specific final size, shape, surface finish, or result.

If a participant handles the material against instructions, creates an unusually thin, fragile, or unstable piece, or modifies the material in a way that makes successful firing difficult, Bubele may not be able to guarantee the final result.

Workshops are suitable for participants aged 14 and over, unless expressly agreed otherwise. Participants under 18 may require the consent of a parent or legal guardian.

Participants are responsible for informing Bubele in advance of any relevant allergies, sensitivities, health conditions, mobility limitations, or other circumstances that may affect their safe participation in a workshop.

SECTION 6 - VOUCHERS AND GIFT CARDS

Bubele may offer vouchers or gift cards that can be redeemed for selected products, workshops, kits, or services.

Unless expressly stated otherwise, vouchers are valid for the value, product, workshop, or service stated on the voucher or product page.

A voucher for an Art Clay Silver workshop is intended for one workshop place and may not be split across multiple purchases, unless expressly agreed by Bubele.

Vouchers and gift cards are not redeemable for cash, except where required by applicable law or expressly agreed by Bubele.

If a voucher has not been used within one year from the date of purchase, Bubele may try to offer a refund where possible. Refunds after expiry are not guaranteed and may depend on payment provider rules, booking conditions, processing limitations, and the circumstances of the individual case.

Lost, stolen, incorrectly entered, or misused voucher codes may not be replaced, unless required by applicable law or agreed by Bubele.

SECTION 7 - SHIPPING, COLLECTION AND DELIVERY

Delivery times provided on our website are estimates only and are not guaranteed.

For workshop jewellery pieces, delivery or collection takes place only after the piece has been dried, fired, finished, polished, packaged, and prepared by Bubele. This process may take several days or longer, depending on the workshop schedule, material behaviour, firing schedule, workload, and delivery conditions.

Customers are responsible for providing a correct and complete delivery address. Bubele is not responsible for delays, failed deliveries, returned shipments, or additional costs caused by incorrect or incomplete delivery information.

We are not liable for shipping or delivery delays caused by carriers, customs processing, weather conditions, supply chain disruptions, incorrect addresses, or events beyond our reasonable control.

Unless otherwise required by applicable law, title to and risk of loss for physical products passes to you upon our transfer of the products to the shipping carrier.

SECTION 8 - INTELLECTUAL PROPERTY

All content available through the Services, including but not limited to text, graphics, logos, icons, images, videos, audio, product descriptions, workshop descriptions, product reviews, page layouts, and the overall design and arrangement of the website, is owned by or licensed to Bubele, its affiliates, licensors, or service providers, and is protected by applicable intellectual property laws.

You may use the Services for your personal, non-commercial use only. You may not reproduce, duplicate, copy, sell, resell, distribute, publish, display, modify, create derivative works from, or exploit any portion of the Services without our prior written consent.

Nothing in these Terms grants you any right, title, or license to any copyright, trademark, trade dress, patent, or other intellectual property rights owned by Bubele, Shopify, or any third party, except as expressly stated.

The name Bubele, our logos, branding, product names, and slogans are trademarks of Bubele or its licensors. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other trademarks shown on the Services are the property of their respective owners.

SECTION 9 - OPTIONAL TOOLS

We may provide you with access to third-party tools or features that we do not monitor, control, or manage.

You acknowledge and agree that such tools are provided “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement by us. We shall have no liability arising from or relating to your use of optional third-party tools.

Your use of such tools is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which such tools are provided by the relevant third-party providers.

Any future features, tools, services, or resources added to the Services shall also be subject to these Terms of Service.

SECTION 10 - THIRD-PARTY LINKS

Certain content, products, services, or functionality available through our Services may include materials from third parties or links to third-party websites.

We are not responsible for examining or evaluating the content, accuracy, or reliability of any third-party materials or websites. If you choose to access any third-party website, you do so at your own risk.

We are not liable for any harm or damages related to your use of third-party websites or your purchase or use of products, services, content, or resources from such third parties. You should review the policies and practices of any third-party website before engaging in any transaction with them.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Bubele is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Bubele, not with Shopify.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bubele, including any injury, damage, or loss resulting from products, workshops, vouchers, kits, or services purchased from us.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bubele.

SECTION 12 - PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy.

Because our store is hosted by Shopify, Shopify may also collect and process personal information in order to provide and improve its services. Information you submit through the Services may be transmitted to and shared with Shopify and certain third parties, including parties located in countries other than your own.

By using the Services, you acknowledge that you have read and understood our Privacy Policy and that certain information may also be subject to Shopify’s privacy practices.

SECTION 13 - FEEDBACK AND USER SUBMISSIONS

If you submit, upload, post, email, or otherwise send us any ideas, suggestions, proposals, reviews, comments, photos, videos, testimonials, or other materials (collectively, “Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, display, and otherwise exploit such Feedback in any medium and for any purpose, including commercial purposes.

You represent and warrant that:

- you own or control all rights in the Feedback you provide;
- your Feedback does not violate the rights of any third party; and
- your Feedback does not contain unlawful, abusive, defamatory, obscene, or otherwise harmful material.

We are under no obligation to keep Feedback confidential, pay compensation for it, or respond to it.

We may, but are not obligated to, monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, infringing, or otherwise objectionable.

SECTION 14 - PHOTOS, VIDEOS AND WORKSHOP CONTENT

During workshops, Bubele may take photos or videos of the workshop setting, materials, tools, hands, jewellery pieces, or general creative process for documentation, marketing, social media, or website purposes.

We will not intentionally publish identifiable images of participants’ faces without consent. If you do not want your hands, jewellery piece, or participation to appear in any workshop-related content, please inform us before or during the workshop.

Participants may take photos or videos for personal use, provided they respect the privacy and rights of other participants and do not disrupt the workshop.

SECTION 15 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website or within the Services may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, workshop descriptions, pricing, promotions, offers, shipping charges, transit times, workshop dates, product availability, or other details.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders or bookings if any information is inaccurate at any time without prior notice, including after you have submitted an order.

SECTION 16 - PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services:

- for any unlawful, fraudulent, or malicious purpose;
- to violate any applicable law or regulation;
- to infringe our intellectual property rights or the rights of others;
- to harass, abuse, insult, harm, intimidate, or discriminate against any person;
- to submit false or misleading information;

- it does not bypass CAPTCHAs, rate limits, access controls, or other protective measures; and
- it responds truthfully to prompts or requests intended to determine whether the interaction is being carried out by a human or a machine.

We reserve the right to restrict, block, or otherwise control whether and how any Agent may access or interact with the Services.

SECTION 18 - TERMINATION

We reserve the right to terminate or suspend your access to the Services, or any part of them, at any time and for any reason, without notice.

If your access is terminated, you remain responsible for all amounts owed to us up to and including the date of termination.

The following provisions survive termination: Intellectual Property, Feedback, Photos, Videos and Workshop Content, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive termination.

SECTION 19 - DISCLAIMER OF WARRANTIES

The Services and all products, workshops, vouchers, kits, handmade items, jewellery pieces, and content provided through them are provided on an “as is” and “as available” basis, except as expressly stated by us in writing.

To the fullest extent permitted by law, Bubele disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee that:

- the Services will be uninterrupted, timely, secure, or error-free;
- defects will be corrected;
- the results obtained from using the Services will be accurate or reliable;
- a handmade workshop piece will achieve a specific size, shape, surface, finish, or appearance after firing and finishing; or
- all workshop materials will behave identically in every case.

Your use of the Services and participation in workshops is at your own risk, to the extent permitted by applicable law.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

SECTION 20 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, neither Bubele, nor its owners, employees, affiliates, contractors, licensors, service providers, nor Shopify and its affiliates, shall be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, revenue, savings, data, goodwill, or replacement costs, arising out of or related to your use of the Services, participation in workshops, or products, vouchers, kits, jewellery pieces, or services purchased through the Services.

To the fullest extent permitted by law, our total liability to you for any claim arising out of or related to the Services, workshops, or products purchased through the Services shall not exceed the amount paid by you, if any, for the product, workshop, voucher, kit, or service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

SECTION 21 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Bubele, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claim, demand, liability, damage, loss, or expense, including reasonable attorneys’ fees, arising out of or related to:

- your breach of these Terms;
- your violation of any law or the rights of a third party;
- your misuse of the Services;
- your misuse of workshop tools, materials, or instructions; or
- your conduct during a workshop.

We may assume control of the defense of any matter subject to indemnification by you, and you agree to cooperate with us in the defense of such claim.

SECTION 22 - SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

SECTION 23 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with any policies posted on this website or incorporated by reference, constitute the entire agreement between you and Bubele regarding your use of the Services and supersede all prior or contemporaneous communications, agreements, and proposals, whether oral or written.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 24 - ASSIGNMENT

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent.

We may assign, transfer, or delegate our rights and obligations under these Terms at any time without notice.

SECTION 25 - GOVERNING LAW

These Terms of Service and any separate agreements through which we provide the Services shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles.

You agree that any dispute arising out of or relating to these Terms or the Services shall be subject to the courts of Zurich, Switzerland, unless otherwise required by applicable consumer protection law.

SECTION 26 - CHANGES TO THESE TERMS

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website.

It is your responsibility to check this page periodically for changes. Where required by law, we will notify you of material changes. Your continued use of the Services after any changes become effective constitutes acceptance of those changes.
